DailyWorship is operated by Intelligent Singularity Inc. ("we", "us", "our"), Suite C, 16644 - 71 St, Edmonton, AB T5Z 0N5, Canada.

These Terms of Service ("Terms") are a binding agreement between you and Intelligent Singularity Inc. governing your use of DailyWorship (the "Service"). Please read them carefully. They include an arbitration agreement and class-action waiver (see "Dispute Resolution") that affect how disputes are resolved, an assignment of rights and limitation of liability, and important disclaimers about AI-generated content.

Acceptance of These Terms#

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy and Content Guidelines, which are incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of a church, organization, or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

Definitions#

"Input" means the prompts, lyrics, titles, descriptions, settings, and any other material you submit to the Service.
"Output" means the audio tracks, lyrics, chord charts, sheet music, stems, and other content the Service generates from your Input.
"Content" means Input and Output together.
"Free tier" means any account or plan that does not include a paid commercial license.
"Paid tier" means a subscription or plan that includes commercial-use rights as described in Rights & Licensing.

Eligibility and Age#

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live (typically 18), you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms. The Service is not directed to children under 13, and we do not knowingly collect their personal information (see Privacy Policy).

Your Account#

Provide accurate, current information and keep it updated.
Keep your password and credentials secure; you are responsible for all activity under your account.
Do not share account credentials or let others use your account.
Notify us immediately at support@dailyworship.net of any unauthorized access.

The Service#

DailyWorship provides AI-assisted worship-music creation and discovery tools, which may include AI music generation, lyric and chord-chart generation, sheet music, audio storage and downloads, service-planning tools, community sharing, and organization collaboration. We may add, change, or discontinue features at any time.

AI and Experimental Technology Notice#

The Service uses machine-learning systems. You acknowledge and agree that:

Output is generated by software and may be inaccurate, unexpected, or unsuitable for your purpose. You are responsible for reviewing Output before relying on or publishing it.
Because models are probabilistic, Output may not be unique. Other users who provide similar Input may receive the same or substantially similar Output, and we do not guarantee exclusivity.
We make no representation or warranty that copyright will subsist in, or be registrable for, any Output. The copyright status of AI-generated content is unsettled and varies by jurisdiction (see Copyright & Intellectual Property).
Output is AI-generated. Where your use of Output is subject to AI-transparency or labeling laws (for example, the EU AI Act), you are responsible for any disclosure those laws require.

Ownership of Content#

Your Input#

As between you and us, you retain ownership of your Input. You represent and warrant that you own or have all rights necessary to submit your Input and that your Input does not infringe or violate any third party's rights.

Output — Paid Tiers#

Subject to your compliance with these Terms and payment of applicable fees, we assign to you all of our right, title, and interest (if any) in and to the Output you generate while on a paid tier, so that you may use it commercially as described in Rights & Licensing. This assignment is subject to the AI-copyright caveat above: we transfer whatever rights we have, but we do not warrant that any copyright exists or vests in the Output.

Output — Free Tier#

On the Free tier, we grant you a worldwide, non-exclusive, royalty-free license to use Output for personal, ministry, and non-commercial purposes only. Commercial use requires a paid tier or separate written permission.

Our Technology#

The Service, including our AI models, software, algorithms, designs, and the DailyWorship name and logos, is and remains our property or our licensors'. These Terms grant you no rights in our technology except the limited right to use the Service.

License You Grant Us#

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your Content solely as needed to: (a) operate, secure, and provide the Service to you; (b) moderate Content and enforce our policies; (c) display Content you choose to make public in discovery feeds; and (d) improve the Service using aggregated and de-identified data.

We do not sell your personal data, and we do not use your private Content to train foundation models without your consent. If we ever offer an opt-in program to contribute Content to model training, it will be clearly described and off by default.

Acceptable Use#

You agree not to use the Service to:

Generate content that infringes any third party's copyright, trademark, or other rights.
Request covers, clones, continuations, or imitations of identifiable artists, songs, lyrics, recordings, melodies, or arrangements.
Clone, mimic, or imitate a real person's voice, name, image, or likeness without their verifiable consent, or create deepfakes or other deceptive synthetic media.
Generate hateful, harassing, discriminatory, sexual, violent, or otherwise prohibited content, or content that is not aligned with the Service's worship focus (see Content Guidelines).
Misrepresent AI-generated Output as human-authored where the law requires disclosure.
Spam, harass, or abuse others; bypass moderation or rate limits; scrape or data-mine the Service; reverse-engineer our models; or build a competing model or service from the Service or its Output.
Violate any applicable law or the rights of others.

Your Representations and Warranties#

You represent and warrant that: (a) you have all rights, consents, and permissions necessary for your Input and your use of Output; (b) your Content and use of the Service comply with these Terms and applicable law; and (c) you will not use the Service in any prohibited manner.

Copyright Complaints and Takedowns#

We respect intellectual-property rights and respond to valid notices of claimed infringement. To submit a notice, or to file a counter-notice, see Copyright Information. We may remove or disable access to allegedly infringing Content and, in appropriate cases, terminate repeat infringers' accounts. Notices may be sent to copyright@dailyworship.net.

Subscriptions, Billing, and Cancellation#

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe) and renew automatically until cancelled. Charges may appear on your statement as CLAPPE.COM. You authorize us and our processor to charge your payment method for applicable fees and taxes. You may cancel at any time; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. Where you have non-waivable statutory rights (for example, EU/UK distance-selling withdrawal rights or Canadian consumer-protection rights), nothing in these Terms limits those rights. Third-Party Services#

The Service may link to or integrate third-party services (for example, authentication or payment providers). We are not responsible for third-party services, and your use of them is governed by their terms.

Termination#

You may stop using the Service and delete your account at any time (see Deleting Your Account). We may suspend or terminate your access if you violate these Terms, engage in fraud or abuse, fail to pay fees, or where required by law or to protect the Service or others. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) survive.

Disclaimers#

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that Output will meet your requirements, or that Output will be free of third-party claims. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you, and you may have statutory rights that these Terms do not limit.

Limitation of Liability#

TO THE FULLEST EXTENT PERMITTED BY LAW, INTELLIGENT SINGULARITY INC. AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, CONTENT, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR OUTPUT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow these limitations, so they may not fully apply to you.

Indemnification#

To the extent permitted by law, you agree to indemnify and hold harmless Intelligent Singularity Inc. and its affiliates from any claims, damages, losses, and reasonable legal fees arising from your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

Dispute Resolution; Binding Arbitration; Class-Action Waiver#

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before starting any proceeding, you agree to contact us at legal@dailyworship.net and try in good faith to resolve the dispute for at least 30 days.
Binding arbitration. Except for the carve-outs below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by ADR Institute of Canada (ADRIC), under its Arbitration Rules, seated in Edmonton, Alberta, rather than in court.
Class-action and jury-trial waiver. Disputes will be conducted only on an individual basis, not as a class, collective, consolidated, or representative action, and you and we waive any right to a jury trial.
30-day opt-out. You may opt out of this arbitration agreement by emailing legal@dailyworship.net within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms.
Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief for intellectual-property infringement or misuse in court.
Consumer carve-out. If you are a consumer in the EU, UK, or another jurisdiction whose law gives you non-waivable rights to local courts or dispute-resolution bodies, this arbitration agreement and the class-action waiver apply only to the extent permitted by that law, and your mandatory local rights are unaffected.

Governing Law#

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to the arbitration agreement above, the courts located in Alberta have exclusive jurisdiction, except where mandatory consumer-protection law gives you the right to bring proceedings in your home jurisdiction.

Changes to These Terms#

We may update these Terms from time to time. For material changes, we will provide reasonable notice (for example, by email or in-product notice). Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree, stop using the Service.

General#

These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control (force majeure). You agree to comply with applicable export-control and sanctions laws.
